You seem to be disadvantaged by your neighbour`s actions here ,especially if they have as you say increased the ground level by 3 feet.

This sounds like a rather selfish and anti-social act on their part.

1] Raising the level of ground is subject to planning permission.

2] There are permitted development rights which enable a maximum patio or deck level of 300mm above the "natural ground level" .

Higher than that requires a planning application.

As a first move and if friendly discussions and requests cannot achieve a mutually agreeable solution, then you might consider contacting the local planning department`s enforcement officer and request him /her to investigate a possible breach of planning regulations .Such a breach might ultimately require your neighbour to submit a formal planning applications showing the proposed increase in ground levels. A set of drawings would need to be submitted to show the various ground levels and possibly involve the need for a land survey to establish ground levels in relation to local benchmark levels and buildings including yours and your neighbour`s. A second and additional course of action is to find out whose responsibility the fence is. Check your title deeds for this. Any impairment to maintaining the fence caused by this augmentation of ground level is a legal matter to raise with your solicitor. Another question which this increase might raise is the impact on any drain covers and inspection chambers and either building control or the body responsible for drains such as Thames water may be interested ,especially if inspection chambers have been covered over or built inappropriately. I would also consider the impact of raising ground levels on possible effect on dampcourses as building regulations require a distance of 150mm from DPC to the ground level.
