8-2-8: DRIVEWAY APRONS:

A. Permit Requirements:

1. Permit Required: No person shall construct or alter any driveway apron over, across or upon any public sidewalk or parkway without first obtaining a permit to do so from the department of code enforcement. A "driveway apron" is defined as any paved roadway between the curb line of any street and the adjacent property line or the parkway side of the edge of the sidewalk, whichever is less. 2. Application For Permit: Application for such permit shall be in writing, signed by the applicant; it shall designate the location of the proposed driveway apron, the name and address of the owner of the property to be served thereby and the address of the applicant, if other than the owner. It shall be accompanied by plans and specifications for the proposed driveway apron. 3. Issuance Of Permit: The department of code enforcement, upon approval of the application and the plans and specifications submitted, shall issue a permit; provided, that the prescribed fee has first been paid. The plans and specifications shall be kept on file in the department of code enforcement. 4. Permit Fee: The fee for such permit shall be as established in title 9 of this code. 5. Revocation Of Permit: All permits for driveway aprons issued pursuant to the provisions of this chapter shall provide that they may be revoked at any time without the consent of the permittee, by the department of code enforcement, and that upon such revocation, all rights granted thereunder shall terminate, and the sidewalk space, parkways and curbs shall be restored to their former condition, all at the expense of the permittee or of the owner of the property served by the driveway apron at the time of any such revocation.

B. Construction Requirements And Specifications:

1. Materials For Construction:

a. Concrete: Concrete driveway aprons shall be constructed in compliance with the provisions of sections 8-2-3 and 8-2-4 of this chapter, so far as they are applicable and shall be not less than seven inches (7") thick if for residential use or eight inches (8") thick if serving commercial or industrial property. In either case, reinforced concrete seven inches (7") thick may be substituted. b. Asphalt Or Brick: Driveway aprons in residential districts may also be constructed of asphalt or brick pavers according to specifications prescribed by the department of public works. 2. Width: Residential driveway aprons shall not exceed twenty feet (20') unless approved by the department of code enforcement. An approach radius of an additional thirty six inches (36") at the curb line is permitted upon the village parkway on each side of the garage driveway. This radius shall begin no further back from the curb line than thirty six inches (36"), beyond which point there shall be no encroachment whatsoever on the parkway in front of the adjoining property.

3. Grades And Curbs: Driveway aprons shall conform to the existing sidewalk grade. Where it is necessary to break the existing curb for the driveway apron, the curb and gutter shall be completely removed and a new section constructed or machine cut as approved by the department of public works. Each such driveway apron shall be constructed and maintained so as to permit free and unobstructed passage on, over or across the same and in such manner as not to interfere with the proper drainage and safe grading of streets. Gradual approaches to the regular sidewalk grade shall be made from the grade of the driveway. The driveway apron entrance shall be one inch (1") above the gutter slab. The slope of any driveway apron and the approaches thereto shall not exceed two inches (2") to the foot in any direction. Each such driveway apron shall be so constructed and maintained that its surface at the point of crossing any sidewalk pavement shall be flush with the adjoining sections of such sidewalk. (1997 Code) 4. Number Of Aprons: Only one driveway apron and associated curb cut shall be allowed for each residence.

a. Exceptions:

(1) One U-shape driveway and related aprons per residence in a location and of a configuration, as approved by the village engineer. (2) In the case of corner lots, one U-shaped driveway and related aprons shall be allowed on one street frontage and one additional driveway and related apron shall be allowed on the other street frontage in a location and of a configuration, as approved by the village engineer, for the purpose of allowing garage access.
